Right of withdrawal for consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

IMPORTANT: You must notify us of the revocation within 14 working days, if possible in writing (§ 355 BGB). If the deadline is not met or if your revocation is not recognizable as such, we cannot recognize the revocation as such!

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the date,

  • on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are or will be delivered uniformly;
  • on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
  • on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, if you have ordered goods that are delivered in several partial shipments or pieces;

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We may refuse to refund you for goods that can be sent by parcel post until we have received these goods back or until you have provided proof that you have sent these goods back, whichever is the earlier.

We collect goods that cannot be sent by parcel post.

You must return or hand over the goods that can be sent by parcel post to us or to 1A profi-pumpe.de UG (haftungsbeschränkt), Service & Lager, Budenheimer Weg 55, 55262 Ingelheim am Rhein/Heidesheim, Germany immediately and in any case within 14 days of the day on which you notify us of the revocation of this contract at the latest. The deadline is met if you send the goods that can be sent by parcel before the period of 14 days has expired.

You shall bear the direct costs of returning goods that can be sent by parcel post and the direct costs of returning goods that cannot be sent by parcel post.

The costs for goods that cannot be sent by parcel post are limited to a maximum of approx. 30 EUR estimated.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Reasons for exclusion or expiry

The right of withdrawal does not apply to contracts

  • for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

The right of withdrawal expires prematurely for contracts

  • for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
  • for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature;
  • for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
  • for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;

IMPORTANT: Please note that we can only generate a revocation if the goods NEW/UNUSED/OVP is.
In the case of products delivered free of defects, in the event of withdrawal you shall bear the Return costs. This also applies if you receive a return slip from us.

Important revocation shipping info!

If you have instructed us to do so, we will collect the goods that cannot be sent by parcel post at your expense from the kerbside, ready for dispatch and securely packed for transportation.you must return or hand over the goods that can be sent by parcel post to us or to 1A profi-pumpe.de UG (haftungsbeschränkt), Service & Lager, (see address below) immediately and in any case within 14 days of the day on which you notify us of the cancellation of this contract at the latest. The deadline is met if you send the goods that can be sent by parcel post before the period of 14 days has expired.
The Germany-wide collection costs for goods that cannot be sent by parcel post are estimated as follows:

  • package/rain barrel to a maximum of around EUR 80,
  • pallet to a maximum of around EUR 150

We ask you to address and stamp the returns accordingly or to use the returns slip we have provided. This will speed up the processing of your request. However, you are free to send the returned goods back to our office address. Please note, however, that bulky goods (including palletized goods) cannot be unloaded there due to a lack of equipment. This information only serves to optimize business processes and in no way restricts your rights as a consumer.

Safe return transportation

If possible, please pack the goods in the original packaging so that no damage can occur to the product during return transportation. In the event of transport damage due to defective packaging, your claims cannot be recognized.
